Terms of Use (ToU)

Version 1.0 — March 2026

Article 1 — Purpose

These Terms of Use (“ToU”) define the conditions under which any User may access and use the Safee mobile application, the Safee Case device, and associated services (collectively the “Service”).

These ToU exclusively govern the use of the Service. Conditions relating to sales, subscriptions, payments, delivery, and warranties are governed by the General Terms and Conditions of Sale (GTC), available at safee.fr/terms-of-service.

Acceptance of these ToU is required upon account creation. Any use of the Service implies full acceptance of the ToU in effect.

Article 2 — Definitions

  • Service: the Safee mobile application and associated services, including alerts, location tracking, trip monitoring, circles, and remote monitoring (depending on the subscribed plan).
  • Device / Safee Case: electronic device connected via Bluetooth Low Energy (BLE) to the User’s phone, equipped with an SOS button and a 105 dB audible alarm.
  • User: any natural person who has created an account on the Safee application.
  • Circle Member: a User invited into a circle by another User, with specific permissions set by the circle creator.
  • Account: the User’s personal space, accessible via login credentials (email/password, Google, or Apple).
  • Alert: the triggering of an emergency procedure, whether manually (via the app or device) or automatically (fall detection).
  • User Content: any data, information, or media transmitted by the User through the Service (profile photos, recordings, etc.).

Article 3 — Access and Registration

Access to the Service requires creating a personal account. Registration may be completed via email, Google account, or Apple account.

Minimum age: Users must be at least 15 years old to accept these ToU independently. For minors under 15, a parent or legal guardian must create the account, accept the ToU on behalf of the minor, and remains responsible for the minor’s use of the Service.

The User agrees to provide accurate, complete, and up-to-date information during registration and to keep it current.

Each person may hold only one account. The User is responsible for securing their login credentials and agrees not to share them with third parties. Any use of the Service with the User’s credentials is presumed to be performed by the User.

Article 4 — Description of Features

4.1 Location and position sharing

  • Real-time GPS tracking (foreground and background).
  • Voluntary position sharing with contacts and circles (can be enabled/disabled at any time).
  • Geofencing: allowed and restricted zones, automatic entry/exit alerts.
  • Saved places (home, work, etc.).

4.2 Emergency alerts

  • Manual SOS trigger via the app or the device.
  • 15-second pre-alarm (cancellable by the User).
  • Fall detection via phone sensors (depending on plan and configuration).
  • Live video and audio broadcast during alerts (via the phone’s camera and microphone).
  • Recording and storage of emergency broadcasts.
  • Automatic notification of emergency contacts and authorized circle members.

4.3 Safee Case device

  • Physical SOS button with BLE connection to the phone.
  • 105 dB audible alarm.
  • Battery level monitoring.
  • BLE proximity scan (detection of nearby Safee devices).
  • Over-the-air (OTA) firmware updates.

Note: the device does not contain GPS, microphone, camera, or accelerometer. Location and sensors come exclusively from the User’s phone.

4.4 Trips

  • Real-time route tracking.
  • Trip sharing with authorized contacts.
  • Trip history.

4.5 Circles and contacts

  • Circle creation with invitation codes.
  • Emergency contact management.
  • Granular per-member permissions (receive alerts, view location, view replays).

4.6 Notifications

  • Push notifications (critical alerts, trips, geofencing).
  • Critical alerts may override the phone’s silent mode.

4.7 Remote monitoring (depending on subscribed plan)

  • Alert transmission to a CNAPS-certified monitoring center.
  • Data transmitted to the center: identity, GPS location, alert type, live audio stream, device information.

Remote monitoring is a supplementary service. It does not guarantee physical intervention and does not replace public emergency services.

Article 5 — Permissions and Phone Access

The Service requires the following permissions on the User’s phone:

  • Location (foreground + background): essential for the safety service (GPS tracking, geofencing, geolocated alerts).
  • Camera and microphone: used for live video and audio broadcast during emergency alerts.
  • Bluetooth: required for connection to the Safee Case device.
  • Notifications: enable reception of alerts and safety information.
  • Contacts: optional address book import to facilitate adding emergency contacts.

Denying one or more permissions may degrade certain features but will not entirely block access to the Service.

The User may modify granted permissions at any time in their phone settings.

Article 6 — Personal Data

Full details of personal data processing are described in the Privacy Policy.

The main categories of data collected include:

  • Identity (name, email, phone, profile photo).
  • GPS location (historical and real-time).
  • Video and audio recordings (only during emergency alerts).
  • Usage data and analytics.
  • Device data (model, operating system, battery level).

Main subprocessors: AWS, Stripe, OneSignal, CNAPS-certified monitoring provider. The complete list is available in the Privacy Policy.

Under the GDPR, the User has rights of access, rectification, deletion, portability, and objection regarding their personal data. These rights may be exercised by writing to contact@safee.fr.

Article 7 — User Obligations

The User agrees to:

  • Use the Service in accordance with its intended purpose: personal safety.
  • Use the Service fairly and in good faith: the Service must be used responsibly, in line with its safety purpose.
  • Not attempt to circumvent, alter, or disrupt the operation of the Service.
  • Not use the Service for unlawful purposes or purposes contrary to public order.
  • Keep account information accurate and up to date.
  • Secure login credentials and not share them with third parties.
  • Respect other Users’ rights, particularly not to distribute third-party replays without their consent.
  • Not engage in reverse engineering, decompilation, or disassembly of the application or firmware.

Article 8 — Non-Substitution for Emergency Services

The Safee Service is a complement to existing safety systems. It does not in any way replace public emergency services (112, 911, or local equivalents).

In case of immediate danger, the User must always contact the relevant emergency services first.

Safee does not guarantee response time, physical intervention, or permanent availability of the Service.

Proper functioning depends on technical conditions beyond Safee’s control: mobile/internet network coverage, GPS signal, phone and device battery level, Bluetooth range (approximately 10 to 30 meters).

Article 9 — Availability and Technical Limitations

Safee commits to deploying all necessary means to ensure the availability and proper functioning of the Service (enhanced obligation of means). However, the Service is not subject to an obligation of result.

The Service depends on external factors, including:

  • The User’s mobile and internet network coverage.
  • GPS signal availability and accuracy (imprecise indoors).
  • Phone and device battery levels.
  • Bluetooth Low Energy range (approximately 10 to 30 meters under normal conditions).
  • Available bandwidth for video/audio streaming.

Service interruptions may occur for planned maintenance (with prior notification when possible), emergency maintenance, or force majeure.

Safee does not provide a Service Level Agreement (SLA) but commits to best efforts to minimize interruptions.

Article 10 — Intellectual Property

The application, firmware, trademarks, logos, interfaces, and Service content are the exclusive property of SAFEE CASES or its licensors.

The User is granted a personal, non-exclusive, non-transferable, and revocable license to use the Service for the duration of their registration.

Any reproduction, modification, distribution, or exploitation of the Service or its components without prior written authorization from Safee is strictly prohibited.

User Content: the User retains ownership of their data and content. The User grants Safee a limited license solely for the purpose of providing the Service (storage, transmission to authorized contacts, transmission to the monitoring center where applicable).

Article 11 — Safee’s Liability

Safee commits to deploying the necessary means for the proper functioning of the Service (enhanced obligation of means).

Safee shall not be held liable for:

  • Malfunctions related to the User’s network, mobile operator, or internet service provider.
  • Hardware or software incompatibilities of the User’s phone.
  • Uses that do not comply with these ToU.
  • Consequences of inaccurate information provided by the User.
  • Failures of third-party services (AWS, monitoring center operators) attributable to them.

Consumers: no liability cap applies for bodily harm and under the legal guarantee of conformity, in accordance with the French Consumer Code.

Professionals: Safee’s total liability is limited to the amounts paid by the Professional Client over the last 12 months, excluding bodily harm.

Article 12 — B2B / Enterprise Features

For professional use, the Service offers specific roles:

  • Moderator: access to location and alert data for all Users within their company.
  • Sub-moderator: access limited to their sub-group and its descendant sub-groups.

The client company is responsible for informing its employees about the use of Safee and the visibility of their data by moderators, in compliance with labor law and GDPR (employee information, proportionality principle).

Article 13 — Suspension and Termination

13.1 By the User

The User may delete their account at any time via the application settings or by writing to contact@safee.fr.

13.2 By Safee

Safee may suspend or terminate a User’s account in case of:

  • Violation of these ToU.
  • Fraudulent or abusive use of the Service.
  • Non-payment (as per the GTC).
  • Legal obligation or court order.

Except in cases of emergency or legal obligation, Safee will notify the User by email prior to any suspension or termination.

13.3 Consequences

Account deletion results in deletion of User data (per the data retention policy described in the Privacy Policy), loss of access to history and replays, and the obligation to return the device on loan for use (commodatum) (as per Article 6 of the GTC).

Article 14 — Modification of the ToU

Safee reserves the right to modify these ToU. In case of substantial changes, Safee commits to:

  • Notifying the User by email at least 30 days before the new ToU take effect.
  • Clearly informing the User about the nature of the changes.
  • Allowing the User to reject the new ToU and terminate their account free of charge within the 30-day period.

Continued use of the Service after the 30-day period constitutes acceptance of the new ToU.

The date of the last update is indicated at the top of this document.

Article 15 — Applicable Law and Disputes

These ToU are governed by French law.

Consumers: in case of a dispute, the User may use a consumer mediator free of charge. The competent mediator is AME CONSO, 197 Boulevard Saint-Germain, 75007 Paris (www.mediationconso-ame.com). The User may also use the European Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr.

An amicable resolution attempt is mandatory before any legal action.

Failing amicable resolution, the competent courts are those of the consumer’s place of residence (Article R.631-3 of the French Consumer Code). For professionals, the Commercial Court of Marseille has exclusive jurisdiction.

Article 16 — Miscellaneous Provisions

Severability: if any clause of these ToU is declared null or unenforceable, the remaining clauses shall remain in full force and effect.

No waiver: Safee’s failure to exercise a right under these ToU does not constitute a waiver of that right.

Assignment: Safee may assign these ToU to a third party subject to 30 days’ prior notice to the User. The User then has the right to terminate free of charge during this period.

Entirety: these ToU, together with the GTC and Privacy Policy, constitute the entire agreement between the User and Safee regarding the use of the Service.
